When does the law go into effect?
January 1, 2007.
What places are smoke-free under the law?
Smoking is prohibited in most public places andworkplaces, including all restaurants withor without attached bars. Smoking will still be allowed in stand-alone bars and casinos.
How does this law impact the patio/outside area of restaurants? Can they be smoke-free?
Outdoor spaces can be designated either smoking or non-smoking by the owner/manager of the restaurant. It is the responsibility of the owner/manager to post the appropriate signs in these areas.
Are the bars inside of restaurants smoke-free?
Yes.
What about restaurants that have video poker?
They are smoke-free.
How do I obey the law as a business owner?
No Smoking signs or the international No Smoking symbol must be clearly posted and ashtrays must be removed where smoking is prohibited. You can download one for FREE.
Does the new law include distances from doorways?
No, but local communities can adopt ordinances that restrict smoking near doorways.
How does this law impact schools?
All grade schools (K-12) are to be smoke-free. This includes all of the buildings, the outside area of the school grounds and the buses.
Does the law allow local communities to make stronger tobacco restrictions for their communities?
Yes. The law repealed the rest of Louisianas preemptive language and now cities can pass stronger ordinances.
What’s preemptive language?
Preemption simply means that no local laws could be stronger than the state law on that subject.
How will the new law be enforced?
Penalties may be cited by any law enforcement officer by giving a citation or summons to appear before a court or proper authority. Fines are different for individuals than they are for employers.
